Terms of service

1. What Markatron is

Markatron lets a teacher print an answer sheet, have students fill it in, scan the sheets with an Android phone, and get grades, statistics and item analysis. Records sync to a web dashboard where you can review and export them.

2. Who may use it

• The Service is for teachers and other adults. You must be at least 18 (or the age of majority where you live) and able to enter into a binding agreement.
• If you use Markatron for your school, you confirm you are authorised to do so.
• Students do not need, and are not expected to create, accounts.

3. Your account

• You sign in with a Google account. You are responsible for that account and for everything done through your signed-in devices. Keep your phone and Google account secure.
• Give accurate information, and keep it up to date.
• One account is for one teacher. Do not share your sign-in or sell access to it.
• Tell us promptly at support@markatron.com if you think your account has been accessed without permission.

4. Your content and your responsibilities

“Your content” means the quizzes, answer keys, classes, student names, results and anything else you enter or generate.

• You own your content. We do not claim ownership of it.
• You give us permission to store, copy, sync, process and display it, only as needed to run the Service for you.
• You are responsible for it, including making sure you have the right, and any consent or school approval required, to enter student information. See the Privacy Policy, Section 11.
• Enter only the student information you need. You do not need a full legal name to grade a sheet.
• Do not use the Service to unlawfully collect, expose, or misuse anyone's personal information.

5. Acceptable use

You agree not to:

• break the law, or use the Service to harm, harass, or discriminate against anyone;
• upload or enter content you have no right to use;
• try to access another user's account or data, or probe, disrupt or overload the Service;
• reverse engineer, scrape, or copy the Service, or work around any limit, safeguard or payment control, including the scan limit and Pro entitlement;
• resell the Service, or use it to build a competing product; or
• use automated means to create accounts or scans.

6. Free and Pro plans

Free. Free accounts include up to 200 free scans. We count scans on each device or browser you use.

Pro. Pro removes the 200-scan limit. Prices, in Philippine pesos:

• Where you buy. Pro is purchased on our website through Paymongo, using methods such as GCash, Maya and cards. The Android app does not sell Pro.
• Manual renewal. Pro does not renew automatically. When you pay again, the new period is added on top of the time you already have, so renewing early wastes nothing.
• When it starts. Pro is active after we receive Paymongo's confirmation of your payment.
• If Pro ends. You keep your account and all your records. Scanning returns to the free limit. You can still view and export everything.
• Changes. We may change prices or what a plan includes. A change never reduces a period you have already paid for, and a new price applies only to payments made after the change.
• Taxes. Prices are as shown at checkout.

7. Refunds

Because Pro is a digital service that is available immediately, payments are non-refundable, except where Philippine law requires otherwise. If you believe you were charged in error — for example a duplicate or mistaken charge, or a payment for Pro you could not use because of a fault on our side — contact support@markatron.com and we will look into it. Nothing in this section limits any right you have under Philippine consumer law that cannot be waived.

8. Grading accuracy

Markatron uses optical mark recognition to read the bubbles students shade. It is built to be accurate under normal lighting and printing, but no scanner is perfect. Smudged marks, damaged or poorly printed sheets, shadows, and unusual printers can cause a misread.

• Review results, especially anything that affects a student's grade, before relying on them. The app lets you check each sheet before you save it.
• The final decision about a grade is yours. Markatron is a tool that assists you.
• Item analysis and statistics are calculated from the results you saved. If a result is wrong, the analysis built on it will be wrong too.

9. Offline use, syncing, and your data

• Markatron is designed to work offline too: you can scan and grade without a connection once you have signed in. Your first sign-in needs an internet connection.
• Records are saved on your device first and synced when you are online. Until they sync, they exist only on that device.
• If you edit the same record on two devices, the version edited most recently is kept and the other is replaced. Check your devices' clocks.
• Photos of answer sheets stay on your phone and are not synced. If you uninstall the app or reset the phone, they are lost.
• Back up what matters. Export your results regularly. We keep your synced records safe, but we cannot recover data that was never synced or never exported, and we cannot promise it will never be lost.
• Updates. To keep syncing safe, we may require a minimum version of the app. If your version is too old, syncing may pause until you update.

10. Our property

The Service, including the app, the website, the grading technology, the design, and the answer-sheet templates, belongs to Markatron and its licensors. We give you a personal, limited, non-exclusive, non-transferable licence to use the Service, and to print the answer sheets for your own classroom use, under these Terms. You may not copy, modify, sell or redistribute them beyond that.

If you send us feedback or ideas, we may use them without obligation to you.

11. Third-party services

The Service relies on others, including Google (sign-in and Google Play), Supabase (database and authentication), Vercel (website hosting) and Paymongo (payments). Their own terms apply to their services. If you installed the app from Google Play, Google's terms apply between you and Google. Google is not responsible for the app or for supporting it.

12. Availability and changes to the Service

We work to keep Markatron running, but it is provided as available. We may change, suspend or end features, and the Service may be unavailable for maintenance, outages, or reasons outside our control. We will try to give notice of changes that significantly affect you.

13. Suspension and ending your account

• You can stop at any time. To delete your account and its data, email support@markatron.com from your account's address with the subject “Delete my account”. See the Privacy Policy, Section 8.
• We may suspend or end your access if you break these Terms, put others or the Service at risk, or if the law requires it. Where reasonable, we will tell you why and give you a chance to export your records.
• After an account is deleted, its records are removed as described in the Privacy Policy, Section 6. Deleting your account does not by itself entitle you to a refund of an already paid Pro period (see Section 7).

14. Disclaimers and limits on our liability

• To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
• To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, grades, records, profits or goodwill, arising from your use of the Service, including grading errors you did not catch (Section 8).
• Our total liability to you for any claim related to the Service is limited to the amount you paid us for Pro in the 12 months before the claim, or ₱1,000 if you paid nothing.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud or wilful misconduct, or any right you have as a consumer that cannot be waived.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. If a dispute arises, please contact us first at support@markatron.com so we can try to resolve it in good faith. If it cannot be resolved, it will be brought in the proper courts of Koronadal City, Philippines, unless the law gives you the right to bring it elsewhere.

16. Changes to these Terms

We may update these Terms as Markatron changes. We will change the “Last updated” date. For material changes we will give notice in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept them. If you do not accept them, stop using the Service and you may delete your account.

17. General

• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we do not enforce a right right away, we have not given it up.
• You may not transfer your rights under these Terms. We may transfer ours as part of a reorganisation or sale of Markatron.
• These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
